How long does probate take in Ohio?

A simple probate in Ohio usually takes about 6-9 months. A complex estate can take 12-24 months. In Ohio, creditors have six months after the death to present their claims, whether or not an executor or administrator has been appointed (Ohio Rev. Code § 2117.06).

Is there a small estate option in Ohio?

In Ohio, the release from administration has a limit of $35,000, or $100,000 for a surviving spouse in some cases (Ohio Rev. Code § 2113.03). The limit is $100,000 when the surviving spouse receives all of the estate: either a valid will leaves everything to the spouse, or there is no will and the spouse inherits everything under Ohio's intestacy law (§ 2105.06, together with the support allowance under § 2106.13). Yes. The court's order can direct delivery of personal property and transfer of real property to the people entitled to it (§ 2113.03(B)); that order can replace the certificate of transfer (§ 2113.61). If there is a will, it must first be admitted to probate (§ 2113.03(F)).
