Ohio executor fee calculator

Ohio executor fees are 4% of the first $100,000 of personal property, income and real estate sale proceeds, 3% of $100,000 to $400,000 and 2% above $400,000, plus 1% of the value of real estate that isn't sold (Ohio Rev. Code § 2113.35).

What the fee is based on

All personal property, including its income, received and accounted for, plus the gross proceeds of real property sold; other property at its date-of-death fair market value (Ohio Rev. Code § 2113.35(A), (C)).

What can change the amount

  • Another 1% applies to some non-probate property that would have counted for Ohio estate tax if the death had been on December 31, 2012, except joint and survivorship property. This calculator doesn't include that part (§ 2113.35(B)).
  • The court can deny or cut the fee if the executor didn't carry out the duties faithfully (§ 2113.35(D)).
