General information, not legal advice. Statutes change, and courts apply them to the facts of each estate. Check with the probate court or a probate attorney before you rely on a figure or a date.

Common questions

Where do these probate forms come from?

From the courts themselves. Every form here was published by a court, a clerk's office or a state judiciary, and each one links to the page it came from so you can check it's the current version.

Which probate forms do I need?

It depends on the state, the county and the kind of case: probating a will, an estate with no will (called intestate), or a small estate. The court clerk can tell you which forms your case needs, and our state probate guides walk through the process.

Can I fill out the forms on my computer?

Many of the PDFs have fillable fields. Some courts need original signatures, a notary or filing through their e-filing system, so check the court's instructions before you file.
