Is there a small estate option in Georgia?
In Georgia, the order that no administration is necessary has no dollar limit (O.C.G.A. §§ 53-2-40 to 53-2-42). Georgia has no dollar-limited small estate affidavit. When there is no will, the heirs can ask the probate court for an order that no administration is necessary, at any estate value, if the estate owes no debts (or every creditor consents) and all heirs agree in writing on how to divide the property. It's only for estates with no will. The order confirms title to real and personal property in the heirs. The court records a certified copy of the order in the deed records of each Georgia county where the person owned real estate (O.C.G.A. § 53-2-40(d)).
