What the fee is based on
Property subject to the jurisdiction of the court: probate property, income received, gains realized on sales above the asset's value and unrealized gains on assets acquired during administration, each valued at its highest value shown in the filings (ORS 116.173(1)–(2)).
Worked example
- Property subject to the court's jurisdiction: $400,000
| 7% of the first $1,000 | $70 |
| 4% of $1,000–$10,000 | $360 |
| 3% of $10,000–$50,000 | $1,200 |
| 2% of the amount above $50,000 | $7,000 |
| Total | $8,630 |
What can change the amount
- The court can allow more for extraordinary or unusual work (ORS 116.173(4)).
- Having more than one personal representative doesn't raise the total. They divide it (ORS 116.173(3)).
